Terms and Conditions

In order to enroll and provide quotes to prospects generated on the Nudge Technologies lead generating engines, these terms and conditions must be acknowledged and agreed to. By checking that you agree to the terms and conditions you, the vendor, agree that you have read these terms and conditions. The terms and conditions of this agreement can be changed at any time without notification, and it is the responsibility of the participating Vendor to evaluate these terms and conditions on a continual basis. Changes will generally be announced via e-mail correspondence.

You Need To Know

We do not guarantee to provide you any specific number of Leads.

We do not make guarantees, representations or warranties regarding a customer's level of interest, their ability to pay you, how accurate the customer's information is, or that any customers will hire you to perform services.

We do not guarantee your level of success with any of the leads we supply. We are not involved in, nor do we have any responsibility for your contracts with customers, their creditworthiness, or any payments to you or any disputes they may have with you or you may have with them.

By joining any Nudge Technologies lead generating engine you certify that you are licensed to conduct business in the state or service area you will request leads for. You must be qualified and capable of performing the services, trade, or tasks you will request leads for. You must be at all times properly and fully licensed, bonded and insured under all applicable laws, industry standards and trade regulations.

Pay Per Lead

Nudge Technologies's pay per lead program is simple. There is no fixed weekly cost, you are simply charged on a per-lead basis with a pre-determined cap. Nudge Technologies assumes the full costs of all on-line marketing. You only pay for the pre-determined, pre-qualified leads you receive each week. You can cancel the service at any time. You are however obligated to pay for any leads you have received up to that point.

Sales leads generated and provided to you will be contacted by your organization only to provide your agreed upon services according to the information provided by the prospective customer and in compliance of the terms and conditions of your membership as a Nudge Technologies Vendor. This prospective customers information is not to be re-sold or used for telemarketing, continuous unsolicited mailings, whether these mailings are electronic or snail mail.

Lead Delivery

All Nudge Technologies Vendors agree to maintain a valid email address for the purpose of lead delivery. Vendors are to inform us immediately of any change in email address, or in that of the personnel.


Our Pay Per Lead program features a predetermined cap on your monthly or weekly cost for qualified leads. You will never exceed the predetermined monthly or weekly cap of leads. Each month will begin at 12:01 AM on the first calendar day and ends at 11:59 PM on the last calendar day of that month. Each week will begin at 12:01 AM Monday and end at 11:59 PM on the following Monday.

Lead Cost

A lead is defined as every completed customer request form with predetermined agreed requirements submitted from our web site to your provided email address. The contact form with all the agreed upon fields must all be filled out completely to constitute a qualified lead. Those particular fields will be determined in the lead filter area of the original enrollment form.

Exclusive Market Area

Depending on the agreed upon program select Nudge Technologies Vendors will have the exclusive rights to all the leads generated in the agreed upon geographical service area listed in the lead filter area of the original enrollment form.

Fees and Charges

Nudge Technologies accepts payment for the Service by credit card only. You must provide Nudge Technologies with current, valid credit card account information at the time that you first subscribe to the Service. Payments are made using one of the major credit cards: Visa, Master Card, and American Express. Vendors agree to maintain a valid credit card on file and to notify Nudge Technologies of any changes that may affect billing. Credit Cards will be charged weekly for leads received over the previous seven days. The invoicing cycle is as follows: One week Monday thru Sunday credit cards charged on Thursday for the previous weeks activity. Statements will be e-mailed on a weekly basis as well.

Lead Dispute

Nudge Technologies Vendors may dispute sales leads by using our easy on-line dispute component. Nudge Technologies lead generating engines will filter a majority of fake leads, occasionally some unqualified leads can slip through unnoticed. Leads that contain bad contact information, fictitious information, and/ or obscenities will be evaluated by Nudge Technologies and credited upon confirmation.

Leads must be disputed within 72 hours of receipt. If the e-mail is not opened in that 72 hour period the lead will become valid and charged to the vendors account.
